Dear Madame Bachelet and delegates and people attending the session, We address ourselves to you on behalf of MUPP in Guatemala (Movement for the Unity of Progressive and Popular organizations),  RPDG (Guatemala Peace and Development Network, organization of the Guatemalan Diaspora in many countries around the world) and ACCISantiago de Chile (chapter in Chile of the Assembly of Citizens against corruption and impunity), in order to alert you to the current situation in Guatemala and the danger of another civil-military dictatorship under president Jimmy Morales. We thank Mme. Bachelet for expressing her concern regarding the recent unconstitutional and illegal actions of the Government of Guatemala against the UN-created International Commission against Impunity in Guatemala (CICIG), as well as the lack of respect of the Executive Power to the rulings of the Constitutional Court (CC). As of now, however, the Government of Guatemala has taken two additional steps towards tyranny. First, the Executive Power is attempting to separate three of the five members of the CC through an illegitimate process in Congress, in order to reverse all adverse rulings. Second, and most dangerous for Guatemala and the international community, Congress is considering the imposition of a blanket amnesty. Such an amnesty was rejected 22 years ago, after the signature of the Firm and Lasting Peace Accord in 1996, when the original Reconciliation Law was approved. This new amnesty would absolve crimes against humanity perpetrated by the armed forces during the internal armed conflict, which just now are reaching the stage of trials in Guatemalan courts. We believe that this attempt to provide absolute impunity undermines all the human rights advances regarding crimes against humanity, including genocide (which was perpetrated in Guatemala), torture and forced disappearances. Therefore, we urge the Human Rights Council to condemn this maneuver and establish very clearly the obligations of the Guatemalan State under international law. We also ask that the Council consider the appointment of a Special Rapporteur to analyze attacks against the doctrine and practice of human rights, which is becoming the trend of dictatorial regimes all over the world. Estimada Sra. Bachelet y delegados, delegadas y demás personas que asisten al período de sesiones, Nos dirigimos a Ustedes, en nombre del MUPP (Movimiento de Unidad Progresista y Popular), en Guatemala, la RPDG (Red por la Paz y el Desarrollo de Guatemala, organización de la diáspora guatemalteca en muchos países alrededor del mundo) y la ACCISantiago de Chile (capítulo en Chile de la Asamblea Ciudadana contra la Corrupción y la Impunidad), a fin de alertar a la comunidad de derechos humanos sobre la situación actual de Guatemala y el peligro de otra dictadura cívico-militar bajo el presidente Jimmy Morales. Agradecemos a la Sra. Bachelet por expresar su preocupación con relación a las recientes acciones inconstitucionales e ilegales del Gobierno de Guatemala en contra de la Comisión Internacional contra la Impunidad en Guatemala (CICIG), creada por las Naciones Unidas, así como por la falta de respeto del Poder Ejecutivo ante los fallos de la Corte de Constitucionalidad (CC). A la fecha de hoy, sin embargo, el Gobierno de Guatemala ha tomado dos medidas adicionales en ruta a ser una tiranía. En primer lugar, el Poder Ejecutivo trata de separar a tres de los cinco miembros de la CC mediante un proceso ilegítimo en el Congreso, a fin de revertir todos los fallos adversos. Y en segundo lugar, que es sumamente peligroso para Guatemala y la comunidad internacional, el Congreso analiza la imposición de una amnistía generalizada. Tal amnistía fue rechazada hace 22 años, luego de la firma del Acuerdo de Paz Firme y Duradera en 1996, cuando la Ley de Reconciliación original fue aprobada. Esta amnistía, que se intenta de nuevo, absolvería los crímenes de lesa humanidad perpetrados por las fuerzas armadas durante el conflicto armado interno, los cuales apenas ahora están llegando a la etapa de juicio en los tribunales de justicia de Guatemala. Pensamos que este intento de proporcionar impunidad total socava todos los avances en derechos humanos con relación a los crímenes de lesa humanidad, incluidos el genocidio (que se cometió en Guatemala), la tortura y la desaparición forzada. Por consiguiente, exhortamos al Consejo de Derechos Humanos a condenar esta maniobra y establecer claramente las obligaciones del Estado de Guatemala bajo el derecho internacional. También pedimos al Consejo que analice el nombramiento de un Relator Especial para estudiar los ataques contra la doctrina y la práctica de los derechos humanos, que se están convirtiendo en tendencia de los regímenes dictatoriales por todo el mundo.
